Buying a home
Buying a home is always stressful, although the result makes it all worthwhile. At Millwards Solicitors, we have the experience and competency to take the pressure off you to enable the whole conveyancing process to run smoothly and with minimal delays.
Every year we handle thousands of conveyances and, during more than 100 years in practice – and with the origin of our business in conveyancing – have built a reputation not only for reliability but expertise reflected in a consistently high number of personal recommendations and excellent satisfaction levels.
Whether this is your first time buying a new home or you are a more experienced buyer. When it comes to buying, we will handle the whole process from start to finish.
There are three main stages:
The pre-contact stage
1, The pre-contract stage starts after you have found a property that you want to purchase. Once you have made an offer on the property and the seller has accepted it.
2, The next step is to arrange a mortgage if you require one and then arrange for a survey on the property.
3, We then confirm your instruction by letter setting out the term of our business and fixed fees.
4, We then contact the seller’s Solicitors to obtain the contract pack and raise any pre-contract enquires. We then carry out the necessary searches and receive a copy of the mortgage offer, if required.

Pre-completion
1. When the queries are answered, arrangements are made for a deposit to be paid in readiness to exchange contracts.
2. You agree with the seller a date by which to complete; on this date, the contracts are formally “exchanged” – meaning both parties are legally committed to the transaction.
3. We prepare a draft transfer deed and completion information form for the seller’s Solicitors. The seller’s Solicitor approves the draft transfer deed, and a final copy is made. The transfer deed may need to be signed by you before being sent to the seller’s Solicitor for signature by the seller in readiness for completion.
4. We prepare a completion statement, carry out pre-completion searches, and apply to your mortgage lender for the mortgage loan.
Post-Completion
1. Upon completion, the seller vacates the property by the agreed time. We send the proceeds of sale to the seller’s Solicitor.
2. The seller’s Solicitor releases the keys to the estate agent (if one was used). The seller’s Solicitor then sends the title deeds and transfer deed to us, together with an undertaking to repay any existing mortgage.
3. We send the stamp duty payable to HMRC, receive the title deeds, transfer deed, and prove that the seller has paid the outstanding mortgage on the property.
4. Register the property in the name of the Buyer at The Land Registry.
5. We will then send you a copy of the registered title from The Land Registry unless the mortgage lender requires the documents, which they may retain until the mortgage is paid.
